It was resolved to recommend to Torridge District Council that this application be refused for the following reasons:

(a) The application is for chalet bungalows. The Case Officer's report on the previous application states ......“the four proposed bungalows on the northern part of the site shall be purely single storey and for the avoidance of doubt chalet bungalows would be unacceptable. The reasons given refer to “appearance” and “amenity of adjoining residents”.

(b) In the appeal decision the Inspector states that 10 dwellings are not feasible. In denying costs to the applicant he states ...”the level of development proposed is fundamentally incompatible with the constraints imposed by the trees.”

(c) Seven of the ten bungalows are adjacent to the northern boundary in approximately half the area of the site. Their appearance is overbearing and to use the Inspector's phrase about the previous application, “cramped and contrived”.

(d) New policies recently put in place have excluded private residential gardens form the definition of previously developed land and the recommended 30 dwellings per hectare is deleted from Planning Policy Statement 3.

(e) The submitted drawings do not show the conservatories on numbers 4,5,6 and 7 Blyth Court nor the one at number 9 Drake Close which are relevant to the recommended minimum distance between the facing elevations of the existing and proposed dwellings.
